On August 10, 2016, Timothy Charles Holmseth submitted a Petition to the United States District Court – District of North Dakota, for an Injunction against every agency known to have collected records and video in the police shooting of David James Elliott.

INTRODUCTION

PETITIONER is not an attorney.

Due to that fact, PETITIONER previously and improperly petitioned the U.S. Court in the District of Minnesota on this matter – Case Number 16-CV-2496 (JRT/LIB. That Petition was subsequently dismissed Without Prejudice due to jurisdiction related matters.

The Judge in the Minnesota filing stated that by “all appearances” the action could have been filed in the U.S. Court – District North Dakota under 28 U.S. Code 1391.

PETITIONER was provided court forms by the U.S. Court in Minnesota to apply for permission to proceed Pro Se based upon income. That application was dismissed as MOOT.

PETITIONER requests the Court provide proper application forms for requesting permission from the Court to proceed PRO SE until such time PETITIONER can achieve legal counsel.

PETITIONER request necessary forms to apply for Court permission to have documents served by the U.S. Marshalls.

PETITIONER believes all wrongful acts, crimes, and torts set forth herein have taken place in the State of North Dakota.

PETITIONER is a resident of East Grand Forks, Minnesota.

PETITIONER believes the United States District Court, District of North Dakota has jurisdiction over the aforementioned Parties and the subject matter stated herein.

PETITIONER believes the North Dakota Federal Court has Venue per 28 U.S. Code 1391.

PETITIONER’S BACKGROUND

PETITIONER is a journalist, author, publisher, songwriter, and media specialist.

PETITIONER has been interviewed by the Minneapolis FBI regarding the kidnapping of HaLeigh Ann-Marie Cummings based upon the FBI’s request for information from PETITIONER’S recorded journalistic interviews with suspects in that case.

PETITIONER was deemed “credible” by Special Agent A.J. Eilerman, Minneapolis FBI.

PETITIONER has received security clearance through the United States Department of Agriculture to enter the secure spaces of a federal facility.

PETITIONER has received first place award from the North Dakota Newspaper Association for reporting and writing.

PETITIONER has participated in a large scale documentary production regarding FBI information pertaining to mass-shooting attacks on Planned Parenthood facilities; and the murder of JonBenet Ramsey.

STATEMENT OF FACTS

PETITIONER believes the facts and circumstances that surround this civil action potentially affect the very safety and well being of the national public and national security.

PETITIONER has been notified by the Grand Forks Police Department that said agency intends to destroy police body-cam and dash-cam public records regarding the pursuit and shooting of David James Elliott (hereby referred to as the Elliott Event) that occurred on February 27-28, 2015 in the State of North Dakota.

PETITIONER seeks for the Federal Court to halt any and all destruction of files pertaining to the Elliott Event.

PETITIONER has standing requests for public records from multiple agencies.

PETITIONER is being improperly denied public records by DEFENDANT CITY OF GRAND FORKS/GRAND FORKS POLICE DEPARTMENT (hereby referred to as GFPD).

PETITIONER is seeking the fulfillment of his Public Records requests from all agencies.

All the aforementioned Parties were involved in the Elliott Event and accumulated records regarding the pursuit and shooting.

PETITIONER has been regularly requesting public records from involved agencies regarding the Elliott Event. PETITIONER has paid many applicable fees for said public records.

PETITIONER has received police-cam evidence from the GFPD that has clearly been altered using a video editor to prevent PETITIONER, and the public, from knowing the true facts and circumstances surrounding the pursuit and police shooting of David James Elliott.

PETITIONER has published a short video that serves as Prima Facie evidence that criminal alterations of police-cams have occurred. PETITIONER is enclosing a CD with this Petition that features the video showing how the body-cams have been altered.

DEFENDANT GFPD via Police Chief Mark Nelson, set forth a “Special Order” on June 26, 2016 to change the retention dates on police-cam evidence in the GFPD’s custody after PETITIONER discovered cam evidence and had been altered to hide criminal and nefarious acts.

PETITONER asserts the “Special Order” was made in bad faith and was done in the act of a Criminal Conspiracy.

RESPONDENT UNIVERSITY OF NORTH DAKOTA – UNIVERITY OF NORTH DAKOTA POLICE DEPARTMENT (hereby referred to as UNDPD) has provided PETITIONER public records that appear to be altered and/or tampered with.

PETITIONER has been threatened by anonymous persons using voice changing software over the telephone and Web and warned to remove all of his websites or suffer serious consequences. PETITIONER’S children and grandchild have also been threatened.

PETITIONER has obtained evidence that shows RESPONDENT(S) are involved in the commission of state and federal crimes including Conspiracy and Attempted Murder.

RESPONDENT GFPD is planning to destroy evidence for the express purpose that it shows RESPONDENT(s) attempted to murder an unarmed man, David James Elliott; and for the purpose of destroying evidence to avoid prosecution.

PETITIONER argues the following supports an Injunction:

Irreparable Harm: If RESPONDENT destroys the files in question, they will never again be retrievable through RESPONDENT’S Keeper of Records.

Clear Legal Right: PETITIONER has a clear legal right to the files, which are public record.

Consideration of Public Interest: There exists a clear public safety issue connected to this case and the files.

Legal Challenge: The stated basis for RESPONDENT’S decision to destroy the files is subject to legal challenge.

CONCLUSION

PETITIONER respectfully requests the United States District Court issue an Injunction forbidding the destruction of GFPD IR#201501332 and/or any police-cam evidence until further order of the Court.

The Order further forbids the destruction of any related files held by the University of North Dakota Police Department, Grand Forks County Sheriff’s Office, Grand Forks County States Attorney’s office, North Dakota Highway Patrol, Altru Health Systems, and Grand Forks County PSAP.

Producers of a North Dakota television station have been caught tricking the American public about a police shooting by showing time-stamps of dash-cam video; but hiding the times on the body-cams.

The reason for the deception is because the Grand Forks Police Department, University of North Dakota Police Department, North Dakota Highway Patrol, and Grand Forks County Sheriff’s Office is covering up what appears to be an attempted murder connected to drug running and the Fraternal Order of Police.

On February 8, 2015, WDAZ, Forum Communications, aired a news story about a police shooting of an unarmed man that happened on February 28, 2015 in the parking lot of a Grand Forks hospital. The WDAZ story featured police body and dash-cam video that was captured during the bizarre two hour long slow speed pursuit of David James Elliott.

The times of events surrounding the pursuit and shooting of Elliott are easy to establish, because Elliott initiated a 911 call very shortly after a police officer tried to pull him over; and he remained on the phone with 911 for 107 minutes until the moment he was shot.

Elliott’s immediate flight from police, as well as other actions, create a strong appearance he personally knew some of the police officers chasing him and was afraid to pull over because he knew he was going to be killed.

Write Into Action has discovered WDAZ-TV used very specific techniques to obfuscate the time stamps on body-cam worn by an officer at the scene of the shooting as the shots were being fired.

WDAZ covered it up because the body-cam times did not correspond to other dash-cam time-stamps that were being used in the same news story.

The news station deliberately perpetuated a fraud upon trusting viewers.

SYNOPSIS OF THE WDAZ-TV POLICE SHOOTING COVER-UP

On February 28, 2015, UND police officer Jerad Braaten emptied his clip into David James Elliott, Grand Forks, in the parking lot of Altru Hospital at 12:47 A.M.

Police refused to talk to the media for three days following the shooting; would not give the public any details and withheld the name of the victim; it was clear something was not right.

Write Into Action made public records requests to obtain police body and dash-cam videos captured before and after the shooting.

However, dash-cam (shown below) shows David Elliott sitting atop the Columbia Road Bridge in his truck at 12:36 A.M. where he actually remained for several more minutes.

Obviously, David Elliott was not in his truck on the bridge and being shot in a distant parking lot at the same time.

Below is another dash-cam snap-shot taken at 12:39 A.M. where David Elliott can be seen talking to officers out the window of his pick-up truck atop the Columbia Road Bridge.

However, according to the body-cam worn by Sgt. Mark Ellingson, GFPD, the shooting is already over (see below) (see You Tube below for actual sound and video).

UND police chief Eric Plummer stated in a televised joint press release that Elliott was shot at around 12:45 A.M.

That time (12:45 A.M.) is essentially the correct time. Police cam obtained by Write into Action captures the sound of gunshots at 12:47 A.M. when an officer is heard saying “shots fired – shots fired”.

Write Into Action began investigating the shooting in 2015 and began requesting police-cam footage from the Grand Forks Police Department after the case was concluded.

That’s when WDAZ suddenly decided to run a story featuring police-cam video.

On February 8, 2016 WDAZ-TV aired a story about the police shooting where they strategically cover up the time-stamps of the body-cam.

During the introduction to the story, which is entirely critical of David Elliott, body-cam captured at the time of the actual shooting is featured behind the presenters Matt Henson and Stacie Van Dyke.

Van Dyke’s shoulder covers the time-stamp the whole time and it is never seen.

Shortly into the introduction, the video in the background changes from body-cam to dash-cam – the dash-cam shows the time of the shooting is 12:47 A.M. (see below).

It is clear WDAZ is allowing the viewers to see the time-stamps on the dash-cam.

PUBLISHED JULY 30, 2016 by WRITE INTO ACTION

Police-cam evidence captured at a police shooting in Grand Forks, North Dakota will not be turned over to Write Into Action by the Grand Forks Police Department (GFPD) without an Order from the federal court.

In a letter dated July 28, 2016, Grand Forks City Attorney Howard Swanson notified Write Into Action (Timothy Charles Holmseth) that existing requests for police-cam public records are now classified as Discovery, and will only be turned over in accordance with Federal Rules of Civil Procedure.

Swanson cites Holmseth v. City of Grand Forks et al. (16-cv-02496-JRT-LIB) (District of Minnesota) as the basis for the City’s decision.

Timothy Holmseth first initiated civil litigation in United States District Court on July 13, 2016 to request an Emergency Injunction that would forbid the planned destruction of police-cam video that capture the police shooting of an unarmed man on February 28, 2015 in the parking lot of Altru Hospital.

Swanson contacted Holmseth after a formal complaint filed by Holmseth against the GFPD Keeper of Records on July 25, 2016, was referred to his office.

Holmseth asserts the GFPD violated state and federal laws when they responded to multiple public records requests for police-cam evidence by providing video that has been carefully altered using a video editor. The alterations were performed to change critical times and conceal specific video pertaining to the events that led up to the shooting of David James Elliott.

North Dakota Bureau of Criminal Investigation (BCI) inventory records show that after the shooting of Elliott, investigators located the body-cam of University of North Dakota police officer Jerad Braaten underneath his UND squad car.

Braaten, the officer that shot Elliott, who was not even scheduled to work on the night in question, further claimed he was not able to produce his car’s dash-cam because, he said, he forgot to put the memory card in the camera.

On June 26, 2016, GFPD Police Chief Mark Nelson issued a “Special Order” that changed the Department’s policy on retention dates for police-cam video evidence.

Holmseth asserts Nelson’s action is part of a criminal conspiracy by a group of public officials to destroy records that will reveal the truth about the Elliott shooting and other crimes in the area – including the mysterious death of Caitlin Jenna Erickson, which occurred the same night.

On June 16, 2016, a person that identified them self as David James Elliott contacted Holmseth and said Braaten attempted to shoot Elliott while atop the Columbia Road Bridge in Grand Forks, several minutes before the actual shooting, but his gun jammed.

The first attempted shooting of Elliott may be what the GFPD is attempting to cover-up in the videos, because it reveals Braaten’s actions were not spontaneous, and he, along with other officers, were stalking Elliott to kill him.

BCI investigation records appear to support the fact something happened atop the Columbia Road Bridge with Braaten’s firearm, because investigators located an un-spent cartridge from his gun that linked to that location.

(Elliott) told Holmseth that Braaten lied to investigators about the cartridge, and only admitted that he had performed a function with his gun on the bridge after he was told the cartridge was found with his “fingerprints” on it.

Holmseth has obtained enough police cam video from the event to demonstrate the video has been altered – and segments of body-cam video that would have shown what occurred on the Columbia Road Bridge have been replaced with other video.

Following the 2015 shooting, UND Police Chief Eric Plummer issued a written reprimand to Braaten for his conduct regarding his police cams.

But life only got better for Braaten who was supplied a lawyer by the Fraternal Order of Police.

Grand Forks States Attorney David Jones said in a letter to Plummer that he viewed all the documents and videos surrounding the pursuit and shooting, and determined Braaten acted reasonably when he shot Elliott.

Braaten was subsequently hired by the GFPD to the exception of other candidates.

Some of the altered body-cam was turned over to WDAZ-TV by the GFPD; the regional North Dakota news station presented an entirely misleading story that made no mention of the fact the time of the shooting in the body-cam videos did not correspond with the dash-cams.

As GOP frontrunner Donald Trump announces an endorsement by Dr. Ben Carson, Fla. Gov. Rick Scott’s aspirations to be tapped as Trump’s VP collapse.

The Scott Administration is unraveling amidst an attempt to cover-up a kidnapping that exposes a government child sex and drug trafficking ring that involves the KKK.

This week, a Florida court heard a post-conviction motion filed by Misty Janette Croslin appealing her 25 year sentence on grounds her attorney, Robert Fields, did not present entrapment as a defense.

Evidence shows Fields knew Croslin was facing entrapment.

The primary players involved William E. Staubs, a bounty hunter involved in multiple trafficking operations in Florida.

Staubs told investigative journalist Timothy Charles Holmseth during a recorded call that he attended a KKK meeting, and personally met with Florida Attorney General Pam Bondi at her office.

Email, audio recordings, a letter to the Florida Attorney General in 2009, and a published article from 2009, are now exposing a high level plot to frame Croslin and black man, Gregory Lewis Page, for the disappearance of HaLeigh Cummings.

The published article reporting the plot to the American public was ‘force removed’ off the Web in 2011 by an un-constitutional, fraudulently obtained, domestic violence protection order that was heard against Timothy Charles Holmseth in a Florida divorce court – filed by a person he never met. The Florida Court ordered Holmseth to retroactively remove already legally published content.

The content was exposing the truth.

Holmseth, East Grand Forks, MN, was threatened with murder if he showed up for the hearing in Broward County, Florida. The death threats were immediately reported to Lt. Rodney Hajicek, East Grand Forks Police Department.

The evidence is the latest to surface that shows the Scott Administration has been covering up all the facts about the HaLeigh Cummings kidnapping, even after receiving audio of Staubs and child sex traffickers discussing child rape pornography of the five year-old that passed through an agent in the Florida DCF underground.

On September 21, 2015, Inspector General Keith Parks and the Florida Department of Law Enforcement received an email from Florida AG Bondi’s deputy director, Becky Kring.

Evidence in HaLeigh Cummings investigation suggests plans to frame a black man

On June 19, 2009, Daniel Smith Lookadoo, 41, Palatka, was arrested on drug charges and his bond was set at $25,000. The Florida Times-Union said the formal charge is sale of cocaine.

Lookadoo is the uncle of Gregory Lewis Page (a.k.a. White Boy Greg), 28, Palatka, who was interviewed by police in February in regards to the disappearance of HaLeigh Cummings. Page had spent the days preceding the child’s disappearance with Misty Croslin, the last person to see the child.

Lookadoo’s girlfriend, Tonya Rigdon, Palatka, said she is concerned about the situation her boyfriend is in. She said law enforcement officials take Lookadoo out of his cell everyday to question him about matters regarding HaLeigh Cummings. She said it is impossible he knows anything at all.

Rigdon is an admitted (recovering) drug addict and admits she has done time in prison.
Rigdon said removing a prisoner from their cell to spend time with the police can place the prisoner’s life in danger because other inmates begin to believe that person is an informant – even if they are not. She said it is done by law enforcement intentionally to solicit statements.

Rigdon said she was with Lookadoo on the night HaLeigh Cummings disappeared. She said the two of them were checked into a motel in Palatka. “We was honeymooning,” she said.

Rigdon said she is concerned that although Lookadoo told the police where he was and who he was with on the night the little girl disappeared, it took them weeks and weeks to come and interview her. She said that worries her, because she was able to easily tell them where he was at, and they stalled in asking.

Rigdon said Putnam County Sheriff’s Department (PCSD) detectives are identifying themselves to Lookadoo as federal agents. “They are introducing themselves to [Daniel Lookadoo] as the feds,” she said, adding that she knows who they are and knows they are PCSD officers. She said the situation is strange and the PCSD officers dress in shirts and ties to look like federal agents. “Everybody’s role playing,” she said.

Lynn Lookadoo, the mother of Gregory Page, said she is very concerned about the situation. She said she is aware of what appears to be a plan to frame her son, Greg Page, in the disappearance of HaLeigh Cumming. She said she read an email sent on March 30, 2009, from the email account of [REDACTED], [REDACTED] for Crystal Sheffield, the child’s biological mother.

The email dated March 30, 2009, sent out to [REDACTED] associates, said (printed as written), “OK guys – Enough of this bullshit personal crap. I’m heading to a deposition. I want the shit to stop – Haleigh is still missing. We either need to find her, or bring the bad guys to the police to face the capital murder charge they deserve. So PULL UP YOUR PANTS, BRUSH YOURSELF OFF…IT’S GONNA BE A BUMPY RIDE. I wanna see Misty being led out of her trailer by police in cuffs on national news by the end of the week. THAT’S OUR GOAL. Let’s get this cocky crack dealer off the streets (see below)!”

Below the text in the body of the email [REDACTED] pasted three photographs of Gregory Page. The photos make Page look like a gangster who is sitting and counting drug money. Rigdon said that is not true. “That was his business,” she said, explaining that he had a store called “All About You” that did screen-printing and the like. She said the business still operates to this day.

“He was trying to act cocky,” Lynn Lookadoo, said. “Like kids do.”
“They don’t even have a body and {REDACTED] is saying find the murderer,” Rigdon said.

Later on March 30, [REDACTED] appeared on the Jane Valez Mitchell show and said REDACTED] had spoken with Page. She said he was under investigation.
A video clip was then played of [REDACTED], Crystal Sheffield: “And I asked [Ronald Cummings Jr.] about it. And I was like, what about the black — the person dressed in black. He said it was a black man dressed in black and he had squeaky shoes, and the couch was bouncing. And that’s just what he told me. And I’m not lying and I have no reason to lie.”

Sheffield’s first version had been that her small son had spoke of a man dressed in black; in this interview she added “black man.”

Lynn Lookadoo said her son Greg had nothing to do with HaLeigh’s disappearance and said she is very concerned about [REDACTED] true character as a person. She said [REDACTED] had come to her house and sat with her and talked – she said [REDACTED] was very charming, friendly, and cordial. “I fixed [REDACTED] a hot meal,” Lookadoo said. “She broke bread at my table, and then she said that about my son (behind our backs).”

Questions of timing have also come into play regarding the arrest and questioning of Daniel Lookadoo.

A week after Lookadoo was arrested, a comprehensive search of property belonging to Marie Griffis, the mother of Crystal Sheffield, was conducted in Baker County, Florida. The search utilized resources from four Florida counties. Heavy machinery, cadaver dogs, divers, and over 40 investigators were involved.

Law enforcement stated publicly they didn’t even expect to find anything.
This statement by law enforcement is troubling to many because of the time, money, and resources that were expend to execute the search many months after the disappearance of the child.

Sheffield knew in advance the search was going to take place.
Following the search, [REDACTED] told the media the Sheffield side of the family requested the search because they wanted all doubt removed about their possible involvement in the child’s disappearance. According to [REDACTED], the police did what they were told.

[REDACTED] stated many times to the media that she was part of the Putnam County Sheriff’s Departments investigative team.

Lt. Johnny Greenwood, PCSD, says that [REDACTED] is not part of their team.

Authorities Alerted

Timothy Charles Holmseth, owner, Write Into Action, had already received information that [REDACTED] solicited assistance from William “COBRA’ Staubs in [REDACTED] plan to place Page somewhere he was not, on the night of the disappearance.

[REDACTED], Donald Knop, also verified such a discussion took place.

Staubs said he told [REDACTED], “No.”

Holmseth filed a formal complaint on June 1, 2009, to the Attorney General of the State of Florida. Holmseth reported he knew of [REDACTED] plan.
The portion of Holmseth’s complaint that addressed [REDACTED[ alleged plan to frame Page read as follows:

Criminal Intent and Illegal Solicitation
Florida Bondsman and Private Investigator William E. Staubs told me Florida [REDACTED] asked him to falsely, and criminally, implicate Gregory Page to authorities in the Haleigh Cummings missing person’s case. Staubs told me he flatly refused. Staubs said he will take a polygraph on this matter.
