Is there a hidden hand guiding the movements of a man charged with rape in Northern Minnesota?

The oddities surrounding the George Lyons rape case gets stranger everyday.

George Lyons, the man charged with 1st degree sexual assault of a minor in Polk County, Minnesota, once worked at the University of North Dakota.

It’s only the latest revelation is the bizarre rape case.

Mystery surrounds the Lyons case because he publically claims to be engaged to Grand Forks State prosecutor Carmell Mattison who does not deny the claim.

Furthering the mystery is the fact there is no longer any record in the Polk County Court’s ‘Register of Actions’ regarding the criminal charges against Lyons.

However, the East Grand Forks Police Department confirmed to Write Into Action there is an “active investigation” regarding Lyons.

Write Into Action learned Lyons was charged in January, 2016 for sexually assaulting a girl. He was reported to UND and was terminated sometime thereafter.

Lyons recently obtained a job where I am employed. .

On Lyon’s first (and only) day of work he told several people he was engaged to the prosecutor that was prosecuting the Delvin Shaw murder trial (Carmell Mattison) in Grand Forks.

Lyons’ connection to UND and the local judicial community raises questions.

UND is plagued with internal crime that includes drug trafficking and child porn.

In February, 2017, UND police officer Paul Bradley Meagher was sentenced after pleading guilty to charges of child pornography following an investigation by the North Dakota BCI and the Department of Homeland Security. 

In July, 2016, Robert William Beattie, a former UND chairman of the Family and Community Medicine Department, was sentenced to 12 years in federal prison for having 3,233 images and 100 videos of child porn.

Eric Hewitt Basile, 37, was charged with eight Class C felony counts of possession of certain materials prohibited in Grand Forks District Court on September 8, 2016 after a UND administration request for a computer search revealed multiple images of children between 1 and 3 years old being sexually assaulted.

Lyons’ association with UND along with his claims to be engaged to a Grand Forks State prosecutor appears extremely problematic.

Higganbotham said he has been pulled over several times in the past few weeks. During one event, he said he was pulled over by UND police who proceeded to have his car searched by a GFPD K-9 unit. The K-9 located nothing but Higganbotham was arrested for an unpaid fine and put in jail. He said he told the police the fine was already paid.

After bailing out of jail, Higganbotham was told by court administration there was an error and he had actually paid the fine.

“I was kidnapped,” Higganbotham said.

Higganbotham said a Grand Forks Police Officer terrorized his mother who had arrived to pick up his automobile. Despite finding no evidence of any crime, the officer told his mother to sell the car and have nothing to do with it (or her son).

Higganbotham said while he was in the Grand Forks County Correction facility, staff member Hunter Nelson, the son of Grand Forks Police Chief Mark Nelson, asked Higganbotham if he works with “Timothy Holmseth”.

On the only day Lyons worked alongside Holmseth, he asked “can we drink anything at work”.

Both Higganbotham and Holmseth locked their car doors while Lyons was present.

Minutes taken during the Alcohol and Other Drug Committee meeting held in January, 2013, lists Lyons as a member and notes UND Police Chief Eric Plummer in attendance.

Court records in North Dakota show Lyons has criminal convictions of delivering methamphetamine and providing alcohol to minors.

The day before I received the video from the North Dakota Attorney General’s office, a vehicle attempted to ram me while I was working and ran me off the road. On another occasion a GFPD police vehicle sat outside my place of employment and waited for me to see it before driving away (captured on my dash-cam).

The police shooting video destroys the false story put out to the public by Grand Forks States Attorney David Jones regarding the shooting and will be included in an upcoming documentary.

U.S. Border Patrol named as defendant in federal lawsuit involving shooting of un-armed man

The United States Border Patrol is named as a defendant in a civil lawsuit filed in United States District Court in North Dakota today.

On August 17, 2016, Timothy Charles Holmseth filed a Complaint to the United States District Court – District of North Dakota, against multiple agencies in North Dakota. Holmseth filed the Complaint after receiving paperwork from the North Dakota Court that provided instructions and forms regarding a previous correspondence to the Court pertaining to a lawsuit.

Holmseth, an investigative journalist from East Grand Forks, Minnesota, alleges a multi-agency and multi-jurisdiction conspiracy exists to cover up the true facts and circumstances surrounding the pursuit and shooting of David James Elliott in 2015.

Elliott was unarmed when he was shot by  a University of North Dakota police officer on February 28, 2015.

The lawsuit alleges defendants are violating public records laws; have defrauded Holmseth’s publication Write Into Action; and are actively violating Holmseth’s Constitutional rights under the First Amendment.

According to Holmseth’s Complaint, defendants, including Grand Forks Police Chief Mark Nelson, have conspired to destroy police-cam evidence of the Elliott Event, which includes deliberately hiding the fact that the United States Border Patrol was involved.

“The criminal conspiracy involves, but is not limited to, GFPD officer (former UNDPD officer) Jerad Braaten, UNDPD Chief of Police Eric Plummer, GFPD Chief of Police Mark Nelson, Grand Forks County Sheriff Bob Rost, GFPD Lt. Derik Zimmel, UNDPD Sgt. Danny Weigel, Grand Forks States Attorney David Jones,” the Complaint said.

Holmseth alleges Defendant Grand Forks Police Department (GFPD) altered police body-cam evidence before turning it over, in effort to hide what truly happened the night a University of North Dakota police officer shot David Elliott multiple times in the head in the Altru hospital parking lot.

Holmseth had been actively requesting and paying for public records regarding the shooting until he was notified by Lt. Derik Zimmel on July 11, 2016, Nelson issued a “Special Order’ on June 26, 2016, changing the retention dates for police cam evidence held in GFPD custody.

Holmseth alleges the Special Order by Nelson was made in bad faith to advance a criminal conspiracy to destroy evidence of an attempted murder.

On July 11, 2016 Lt. Derik Zimmel advised Holmseth he had until July 18, 2016 to make any further requests for records and then the records would be “subject to destruction”.

On July 17, 2016, Holmseth submitted a public records request to the City of Grand Forks that said, “Pursuant to all applicable state and federal laws, I am requesting ALL officer body-camera videos; ALL police dash-cam videos; ALL reports, notes, ledgers, transcripts, and other records pertaining to the pursuit and shooting of David James Elliott.”

On July 28, 2016 Holmseth received a letter from Grand Forks City Attorney Howard Swanson advising that no more records would be turned over because they were now deemed legal Discovery.

Holmseth alleges the Elliott shooting was actually a pre-mediated murder and possibly an ordered ‘hit’ that involved drug trafficking through the State of North Dakota.

North Dakota Bureau of Criminal Investigation (BCI) records show the BCI seized “thousands” of pills from Elliott’s vehicle following the bizarre two hour slow speed chase through multiple counties that was all captured on a 107 minute 911 call placed by Elliott – but never heard by the public. Elliott was talking to a GFPD officer during the 911 call.

Holmseth is the only publisher to request any portion of the 107 minute 911 call, which cost over a hundred dollars in fees for just a few minutes of the call.

David James Elliott contacted Holmseth and said law enforcement hid and/or destroyed body-cam evidence that showed police officer Jerad Braaten attempted to shoot him while he was sitting atop the Columbia Road Bridge in Grand Forks.

“What they don’t tell you is that the officer that shot me tried to shoot me at the top of the university bridge were I stopped and was hanging half way out the window with my hands straight out but his gun misfired – so he pulled his gun back on top to dislodge the bullet and they found that bullet there on top of the bridge with nobody taking claim to it until they pulled his finger prints off of the damn thing,” Elliott said.

The first attempted shooting of Elliott by Bratten changes exposes the entire false narrative that was subsequently given to the public because it shows Braaten was stalking Elliott to shoot him.

“When [Jerad Braaten] shot me everyone was yelling ‘cease fire’ and nobody even knew who was firing until it was all done – and the cop that supposedly got drug by my vehicle wasn’t ever in danger – let alone near the driver’s window – and the cop that shot me on video said ‘I thought you were in danger’ and he yells ‘I wasn’t in danger at any given time and was upset,” Elliott said.

Elliott told Holmseth police used “Excessive Force” and the Grand Forks States Attorney’s office told his lawyer, Darla Schuman, they were charging him with felonies so he wouldn’t sue.

The excessive force appears to involve more than the unwarranted shooting.

“There is so much to this whole thing that people will never know or even understand. Heck after the first two to the third shot fired, my pickup was stopped and he just kept on shooting me. He fired 14 times total until his gun was empty and 8 hit me – and a total of ten hit my truck – and two hit the Kidney Dialysis Center way off to the right and two hit the E/R hall way way off to the left,” Elliott said.

“I got shot 8 times – not 6 or 7 – and then after I got shot and was laying on the steering wheel knocked out with blood all over the place and my left hand missing two fingers -two other officers from GFPD ran up to the drivers window and freaken tazed my lifeless body not once but twice – and they’re yelling put your hands up quit resisting as they open the drivers door and my body falls out of the truck like a sack of potatoes,” Elliott said.

“That’s the video nobody has seen – and I have it,” Elliott said.

Grand Forks PSAP confirms GFPD officer entered false information into police report on night of police shooting

Cover-up leads to Somalian man charged with attempted murder

Grand Forks County PSAP has confirmed that data entered into a police report filed by a Grand Forks Police officer involved in a police shooting – was false information.

The latest discovery of deception is not new in the case.

Evidence of a wide scale cover-up by North Dakota Attorney General Wayne Stenehjem, Grand Forks County States Attorney David Jones, and other high ranking law enforcement officials continues to emerge regarding the police pursuit and shooting of David James Elliott on February 27-28, 2015.

Grand Forks 911 has confirmed Matthew Bullinger, an officer with the Grand Forks Police Department (GFPD), entered information into an electronic police report that did not match PSAP records.

Bullinger was a key figure in the events that surrounded the pursuit and shooting of Elliott.

There appears to efforts underway to frustrate Write Into Action’s attempts to obtain information. Write Into Action has made multiple public record requests for information to the GFPD regarding the Elliott case. Every text document involving 911 transcripts and/or police communications provided by the GFPD has not included the ‘time’.

The latest discrepancy was discovered after Write Into Action directly contacted Grand Forks PSAP and asked for the specific time of an event. PSAP personnel then identified the specific times that were in question.

The report filed by Bullinger is a critical piece of evidence in the timeline of events that took place shortly before the Elliott pursuit, and may ultimately lead to even more explosive developments regarding an immigrant from Somalia that was charged with attempted murder shortly after the Elliott fiasco.

There is a reason why GFPD is neglecting to give ‘times’ of events.

On February 27, 2015, at 10:49 P.M., Bullinger entered a Computer Assisted Dispatch (CAD) report that said he was dispatched to 1850 South 34th Street, Unit 217, Grand Forks, at 10:45 P.M.

The ‘time’ Bullinger placed in the report is false.

“The time PSAP received the loud party call was 2216 hours (10:16 P.M.), and it was then dispatched at 2233 (10:33 P.M.) hours, matching both our communication times and call entries in the computer,” said Shannon LaHaise, Center Supervisor, Grand Forks PSAP.

Bullinger’s claim that he was dispatched at 10:45 P.M. was off by12 minutes.

Those 12 minutes are critical.

Here’s why.

Bullinger, as well as GFPD officer Dan Harvala, were interviewed by the North Dakota Bureau of Criminal Investigation (BCI) regarding the police shooting of Elliott.

Both Bullinger and Harvala responded to the loud party complaint on South 34th Street.

Grand Forks Police Department Officer Dan Harvala indicated there was a suspicious vehicle complaint from the Public Safety Answering Point (PSAP) pending and that once he cleared the loud party complaint he responded to the suspicious vehicle complaint. The BCI report shows Bullinger and Harvala responded to the loud party complaint BEFORE responding to the ‘suspicious vehicle’ report, which was “pending”.

The “pending” call was made by the cleaning lady at Wells Fargo Bank to report a ‘suspicious vehicle’ (David Elliott) at 10:41 P.M.

Write Into Action will now do ND AG Wayne Stenehjem and Grand Forks States Attorney David Jones’ jobs for them.

Observe:

• Bullinger and Harvala are dispatched to a loud party call at 10:33 P.M.
• For some reason, Bullinger and Harvala don’t respond to the 10:33 P.M. dispatch
• Eight minutes later, at 10:41 P.M., the cleaning lady at Wells Fargo Bank calls 911 to report a suspicious vehicle (David Elliott) lingering in the parking lot
• Bullinger and Harvala don’t respond to the Wells Fargo call either, but, now, rather, respond to the loud party complaint that has been in the system since 10:33 P.M., and leave the Wells Fargo call that came at 10:41 P.M. ‘pending’
• Bullinger then files a CAD report at 10:49 P.M. saying he was dispatched to the loud party complaint at 10:45 P.M. (which is a lie because it was dispatched at 10:33 P.M.) and is now clearing it

UND POLICE OFFICER JERAD BRAATEN

UND police officer Jerad Braaten shot Elliott on the night in question.

According to BCI records, Braaten was not scheduled to work on the night in question but did. After somehow becoming scheduled to work he was supposed to begin his shift at 11:00 P.M. However, he began his shift at 10:30 P.M. instead. He did not activate his dash-cam apparatus, which he said he forgot to do. He did not properly place his body-cam on himself so it did not capture the shooting. The body-cam did not fit properly because he was not wearing his regular uniform.

So where was Braaten at 10:30 P.M.?

According to dispatch records obtained from UNDPD, Braaten was at South 34th Street at 10:30 P.M. performing a traffic stop.

Ok – that’s two GFPD officers and one UND officer at South 34th Street at the same time.

Is there anything special or unique about the address of the loud party complaint that was at 1850 South 34th Street, Grandview Apartments, Unit 17, Grand Forks, North Dakota?

Well, let’s see.

A Grand Forks man has been charged with Attempted Murder, Terrorizing and Reckless Endangerment, after a gun was fired in an apartment Thursday night. Police responded to this apartment at 1850 South 34th Street at 11:30 Thursday night, after getting a report of gunfire.
